US Supreme Court maintains mail access to abortion pill for now

Washington DC: The United States Supreme Court has temporarily preserved nationwide access to the abortion pill mifepristone via mail, extending a stay on a lower court’s restrictive order for another three days.

The decision, issued on Monday, pauses a ruling from the 5th Circuit Court of Appeals that sought to ban mail delivery and pharmacy access, instead requiring patients to obtain the medication in person from health clinics.

This stay remains in effect until Thursday, allowing manufacturers time to prepare an emergency case for the nation’s highest court.

The legal challenge originated from a lawsuit brought by Louisiana against the Food and Drug Administration (FDA). While anti-abortion activists have questioned the safety of the drug, mifepristone has held FDA approval since 2000 and is currently used in the majority of American abortions.

As more than 20 states have already restricted abortion following the 2022 overturning of Roe v. Wade, the outcome of this case will determine the future of telemedicine-based reproductive healthcare across the country.
