Court Appeal Fails Over BD9,000 Crash Payout

An appeal by a woman found liable for a crash that left a man injured has been dismissed by the High Civil Appeals Court, which upheld a ruling ordering her to pay BD9,000 in damages.

The collision occurred on 12 July 2024 when she drove through a red light and struck the man’s vehicle.


Surgery

He sustained a fractured thigh requiring surgery with metal pins, along with a knee wound that left him with reduced movement in his leg.

The claim was handled by lawyer Jassim Al Essa on behalf of the injured party.

The lower court had awarded BD9,000 in compensation for both physical injury and emotional harm, in addition to legal fees, medical committee costs, and translation expenses.


Amount

The woman challenged the amount, arguing it was too high given the circumstances and asked the court to reduce it to BD5,000.

On 31 July 2025, the appeals court dismissed the claim, stating the original ruling was well founded.

It accepted the evidence presented, which included the traffic report, medical documents, and a criminal court verdict that found her guilty of careless driving, ignoring a red signal, and causing damage to another vehicle. She had been fined BD1,000.


Disability

The injured man had also been referred to a medical panel, which concluded he suffered a 15 per cent permanent disability.

His lawyer later raised the compensation request to BD10,000, citing physical pain, emotional distress, and the impact on his family.

On 29 May 2025, the first court awarded BD9,000, along with BD20 in legal costs, BD90 for the medical panel’s report, and BD10 in translation fees. Other claims were dismissed.


Ruling

The appeals court found no grounds to alter the ruling.

The woman was ordered to pay BD177.500 in appeal costs, deducted from the BD196.500 she had already paid into court. The remainder is to be returned to her.
