A court has rejected a man’s attempt to exercise a registered right of residence in a property after he had not lived there for more than 15 years. The property had originally been registered in his name before he transferred it to his wife while retaining a registered right of residence.
The husband later alleged that his wife changed the locks and prevented him from accessing the property before transferring it to a relative. The new owner did not object to the husband exercising his right of residence but opposed him bringing his second wife into the property.
The Court of Appeal overturned the First Instance Court’s ruling after finding that the statutory 15-year period had expired. Citing Article 923 of the Civil Law, the court ruled that a claim concerning a right of usufruct, including a right of residence, could no longer be heard because the right had not been exercised within the prescribed period.
