Court Raises Accident Compensation Amount
The Civil Court of Appeal increased compensation awarded to a family following a traffic accident after new medical findings revealed the injured victim's worsening condition. The total compensation rose from 16,000 to 20,000 Bahraini dinars after the appellate medical committee confirmed that the victim’s permanent disability had increased from 20% to 30%.
The case stems from an accident caused by a driver found guilty of negligent and inattentive driving. The vehicle involved was insured, making both the driver and the insurance company jointly liable for damages.
Initially, the court awarded compensation based on a 20% disability assessment. However, the victim’s family challenged the ruling, arguing that the injuries and their impact had been underestimated. Upon appeal, a new medical evaluation confirmed a higher disability rate, prompting the court to revise the compensation.
Under the amended ruling, the injured victim was awarded 18,000 dinars, while the father received 1,000 dinars for moral damages. Compensation for the siblings was also increased to 1,000 dinars each. Additionally, the court upheld 270 dinars for medical expenses and ordered the defendants to cover legal fees, court costs, and expenses related to the medical committees.
