Three to serve jail term after sentence reversal

The Deputy Head of the Execution Prosecution at the Public Prosecution announced the cancellation of the alternative sentences granted to three convicted individuals and ordered the enforcement of their original sentence of three months’ imprisonment.

The decision came after it was proven that the individuals committed the offense of failing to disclose their financial information in ongoing civil execution cases against them.

This violated legal provisions requiring debtors to disclose their assets to satisfy enforceable court judgments.

The competent court had previously sentenced each of them to three months in prison but replaced the original sentence with an alternative penalty aimed at repairing the damage, after the convicts initiated financial disclosure as required by law.

However, they later failed to comply with the alternative sentence by refusing to complete the required disclosure, and the given period expired without fulfilling its conditions.

This led to the cancellation of the alternative sentence and the enforcement of the original prison term.

The Deputy Head of the Execution Prosecution also emphasized that the Enforcement Law is designed to balance the rights of creditors and debtors.

It protects the rights of creditors holding enforceable judgments while also allowing debtors to disclose their financial status, including any insolvency, to avoid compulsory enforcement measures.
