Unlawful dismissal: Five employees compensated

Five former employees have won compensation after the High Labour Court ruled their dismissal lacked a lawful cause following the closure of their employer’s Bahrain branch.
The court ordered the company to pay outstanding termination sums, accrued leave, end-of-service gratuities, statutory interest, and legal costs.
The awards included balances ranging from BD1,443 to BD7,224 for unfair dismissal and termination compensation, with additional sums for annual leave and end-of-service benefits. Lawyer Maryam Al Shaikh said her clients had been employed on open-ended contracts and were notified in late 2024 that their services would end due to the branch closure. They argued the wider business remained active and their dues were unpaid, prompting the legal case.
The court found the company failed to provide a legitimate reason for the terminations, citing Article 101 of the Labour Law, which places the burden of proof on the employer. As a result, the dismissals were deemed unlawful, and compensation was a warded.
