Woman hurt in rear-end crash awarded BD9,000

A woman who suffered a head injury in a rear-end crash has won BD9,000 dinars in damages after a civil court ruled that the driver at fault and his insurer must pay up.

The High Civil Court also held the pair jointly liable for court costs, a contribution towards her legal fees, and 90 dinars to cover the medical committee’s fees.

The woman sued the insurance company as first defendant and the motorist as second defendant, asking to be referred to medical committees to assess the lasting harm she said the crash had caused.

Compensation

She also sought compensation for material and moral damage, plus statutory interest from the date of the injury until full payment. Her lawyer, Mohammed Al Mahdi, said she was travelling with her grandson when another car, insured with the first defendant, drove into the back of their vehicle.

The claim said the second defendant failed to keep a safe distance and did not take proper care and attention, leaving the woman with various injuries and causing damage to the car.

The driver had already faced criminal proceedings in the Minor Criminal Court on charges linked to causing harm through his fault by failing to take the required care while driving. He was fined 100 dinars, paid it, and did not appeal, making that ruling final.

In the civil case, the court appointed medical committees to examine the woman and report on her condition.

Injury

They said she suffered a head injury involving a fracture and a small haemorrhage that was treated.

The report noted pain at the site of the injury, dizziness and reduced vision, and put her permanent disability at 20 per cent.

In its reasoning, the court cited Article 158 of the Civil Code, which states that anyone whose fault causes harm to another must compensate the injured party.
