Bahrain Court upholds ruling on Amwaj Islands dispute

The Court of Cassation delivered its final verdict on April 1, dismissing the appeal filed by 133 residents of Amwaj Islands against the Board of Directors of the Central Federation and the development company.

The court affirmed the legality of the procedures conducted during the General Assembly meeting in 2020, including budget approval. After thorough review of submitted documents, the Court of Cassation endorsed the expenses allocated by the Central Union for managing common areas, deeming them valid and authorized.

A report from the Real Estate Regulatory Agency’s neutral observer further supported the procedural integrity of the Union’s actions.

Resolution

President of the Central Federation, MP Ahmed Sabah Al-Salloum, hailed the court’s decision as a resolution to unwarranted disputes.

He emphasized the ruling’s foundation in law and documented evidence, expressing optimism for a new era of organized efforts to restore Amwaj Islands’ stature as a premier residential and leisure destination in Bahrain.

Al-Salloum reaffirmed the Union’s commitment to transparency and quality service provision to all residents and owners, highlighting the availability of a comprehensive website for accessing relevant information.

Legal representative Abdullah Salman Sahwan confirmed the Court of Cassation’s validation of the initial General Assembly meetings, the Board of Directors’ formation, and the dismissal of the lawsuit challenging the Assembly’s legitimacy. Moving forward, the Union pledges to uphold transparency, enhance services, and undertake initiatives to enhance the appeal and attractiveness of Amwaj Islands.

Compliance

Sahwan emphasized the adherence to proper convening procedures and subsequent decisions, all conducted in compliance with existing laws and regulations. He highlighted the diligence of Union officials in seeking approval from the Real Estate Regulatory Authority, as mandated by Law No. 27 of 2017.

Furthermore, Sahwan urged all property owners to respect Union decisions and refrain from spreading unfounded rumors that could disrupt property values on Amwaj Island.
