Private clinics face fines, suspensions for breaching rules

Daily fines of up to BD2,000, service suspensions and licence action for private clinics that break the rules are proposed in a Shura Council draft law to amend Article 23 of the Private Health Institutions Law.

The proposal targets Article 23 of Decree-Law No. 21 of 2015 on Private Health Institutions, as amended by Law No. 1 of 2019.

It is signed by Shura members Dr Ebtesam Al Dallal, Dalal Al Zayed, Dr Jameela Al Salman, Dr Ahmed Alorrayed and Dr Hani Al Saati.

Under the draft text, once a violation is proven, the Accountability Committee would order the institution to stop the breach and remove its causes or effects straight away, or within a deadline set by the committee.

If the institution fails to comply, the committee could issue a reasoned decision imposing measures that start with a written warning.

Those measures include the temporary suspension of some services, on condition that patients’ interests are not harmed.

The committee could also recommend removing medical, technical, nursing or administrative staff from their posts if their responsibility for the violation is established.
