A buyer who says he paid BD55,500 in full for two residential flats has secured a High Civil Court ruling ordering the transfer of title after a property investment firm declined to notarise the sale contracts, leaving the units at risk of being swept into enforcement steps against the company.
The court ruled the two contracts valid and enforceable, and ordered the Survey and Land Registration Bureau to register the transactions, issue separate title deeds in the buyer’s name for each flat, and hand them over to him.
The firm was ordered to pay court costs and a contribution towards legal fees.
Lawyer Sanad Bucheeri said his client brought urgent proceedings against the company and the Survey and Land Registration Bureau after the firm failed to complete the paperwork needed to document the contracts and transfer ownership, despite repeated requests and full payment.
The buyer said he later discovered enforcement files against the company that included requests to place notes against its properties.
