Repayment of BD 80,000 ordered in financial dispute by Court

Manama: A Bahraini court has ruled in favour of a claimant in a financial disagreement that escalated into litigation after one party failed to honour a debt. The judgment requires the defendant to pay BD 80,000 plus costs and attorney fees following a review of the evidence presented in court.

The case arose when the plaintiff brought a lawsuit seeking repayment of an agreed sum that had not been settled despite repeated demands. The defendant denied ever owing the money and challenged the authenticity of the written acknowledgement, claiming it was fabricated and signed without his consent.

During the proceedings, the judge examined testimony from both sides and ordered an expert to analyse the disputed document. The specialist’s findings indicated that the record had been created after the dates asserted by the defence, casting doubt on its validity. However, the claimant’s lawyer also submitted communication suggesting cooperation between the parties in drafting the document.

Applying legal principles that require the borrower to prove that a debt has been cleared, and noting the absence of evidence showing any repayment, the court determined the creditor’s claim was substantiated. The ruling instructs the defendant to reimburse the owed amount, cover legal expenses, and pay BD 1,000 towards lawyer fees.

Justice officials noted that a written acknowledgment of debt, unless convincingly disputed or shown to have been obtained through fraud, carries significant weight in civil cases. In this instance, the documentation and accompanying materials were deemed credible enough to support the plaintiff’s entitlement to the funds.
