Civil Court Orders $90,000 Repayment to Gulf Investor After 10 Years

Bahrain’s Civil Court has concluded a long-running investment dispute by ordering the fourth defendant to repay $90,000 to a Gulf investor. The court also mandated payment of legal costs totaling 776.500 Bahraini dinars, attorney fees of 1,000 dinars, and expert fees of 500 dinars. The ruling came after the defendant failed to return the principal or provide any profit from the investment.

According to the investor’s lawyer, Dina Al-Gumaish, her client held an investment portfolio with the defendants and contributed $90,000 in 2007 based on an investment offer. The agreement specified that the principal and any profits would be returned after five years, linked to a memorandum for investment in an infrastructure project.

Al-Gumaish explained that, despite the passage of time, her client received neither profits nor the initial investment. The defendants consistently refused repayment for nearly a decade, from 2014 until the lawsuit was filed, causing direct financial losses.

The lawyer stated that formal notices were sent via registered mail demanding repayment, but the requests were ignored, leaving litigation as the only recourse. In her arguments, Al-Gumaish emphasized that the defendants were financially obligated to return the investment and had breached their contractual commitments.

The court noted that evidence and the expert report confirmed the $90,000 was deposited into the fourth defendant’s dedicated bank account under the investment memorandum issued in July 2007, making her responsible for managing and returning the funds. There was no proof that any profits had been paid or that the principal was returned after the agreed five-year period, constituting a clear contractual violation.

Consequently, the court ordered the fourth defendant to repay the $90,000 investment along with all associated costs, attorney fees, and expert fees.
