Court orders partner to pay BD13,423 over undelivered car

A civil court has ordered a man to pay his business partner BD13,423 after a twocar import deal from the United Arab Emirates broke down when a second vehicle was not handed over.

The order includes costs and BD50 in lawyers’ fees.

The partners had agreed to bring in two luxury cars for resale in Bahrain. One Range Rover arrived and was passed to the claimant.

The second car, although brought in, was neither delivered nor repaid despite attempts to settle the matter informally.

For the claimant, lawyer Siddiqa Al Mawali filed the case with copies of exchanged electronic messages and sought BD13,423, plus fees and expenses, or failing that a referral to inquiry.

She said her client had paid BD13,423 under the deal to bring cars from the UAE and that the defendant neither handed over the second car nor returned its price.

The court heard two witnesses.

Agreement

The first, called in to translate between the parties, said there was an agreement to buy two luxury cars; that the claimant paid more than BD26,000 in total; and that the defendant admitted receiving the money and asked for time to sell the cars and return the price.

The second said the defendant owns a car trading and import company, asked the claimant for funds to import vehicles, received BD13,400, travelled to the UAE and sent photos of both cars.

Total price

She added the pair agreed a total price of BD26,500, which the claimant paid in cash by instalments, and that she was present at the deal.

The court said it was satisfied with the witnesses.

It found the agreement and the debt proved, and noted the defendant offered no proof of payment or discharge.

It ordered him to pay BD13,423 to the claimant, together with costs and BD50 in lawyers’ fees.
