Court Overturns Decision in Forged Resignation Case

The High Civil Court annulled an administrative decision that had accepted a worker’s resignation as valid, after establishing that the resignation was forged and linked to improper procedural conduct involving an attempted transfer to another employer.
The court ruled that the worker left his job in violation of work permit conditions and that a prior final judgment confirming absconding removed any legal basis for his labour claims.
According to lawyer Huda Saad, the worker attempted to move to another employer without informing his original employer and allegedly forged a resignation letter by signing and backdating it to appear legitimate.
Procedures
She said the employer followed legal procedures and filed a work abandonment notification after the employee failed to comply with regulations. Although the worker later submitted a resignation via email, it did not follow approved formal procedures and included irregularities, including the disputed signature.
Despite this, the grievance was initially accepted and the resignation considered valid, prompting the worker to file claims for labour entitlements. However, the court found that the administrative decision lacked a proper legal basis because it relied on an unverified resignation and ignored established findings.
Judgment
The ruling referenced a prior final judgment confirming that the worker had absconded on March 7, 2024, based on witness testimony. The court also noted subsequent legal consequences, including cancellation of residency and a criminal ruling for illegal stay.
The High Civil Court concluded that the employment termination had already been definitively settled and could not be re-litigated, making the administrative decision invalid.
The court ultimately upheld the work abandonment notification, overturned the challenged administrative ruling, and ordered the worker to bear legal costs and attorney fees.
