Worker wins BD1,000 in unlawful dismissal case

Claims that a worker leaked clients and kept company property were thrown out by the High Civil Court, which awarded him BD1,000 after ruling that a logistics firm had ended his job without lawful cause.

The court ordered the company to pay BD500 in notice pay and a further BD500 in compensation for wrongful termination. It also ordered it to pay costs and BD100 in legal fees.

Lawyer Taqi Hussain brought the case for the worker, who had joined the company in 2024 under an open-ended contract as a work supervisor on a monthly wage of BD500.

He told the court his job was ended in June 2025 without lawful cause, without proper notice and without payment of his labour dues. The company said the dismissal was justified.

It told the court the worker had broken his duties, disclosed company secrets and passed current clients to a rival business.

It also said a criminal complaint had been filed over a Galaxy S24 Ultra handset which it said had been handed to him during his employment and not returned.

To make its case, the company filed an internal inquiry report said to contain the worker’s admission, papers showing he had been suspended from work, a copy of the criminal complaint, and records which it said showed he had been told of his dismissal and of a salary deduction linked to the missing phone.

Evidence

Two witnesses also gave evidence for the company. One told the court the worker had passed clients to another company and had admitted the breaches during an internal inquiry.

The second gave evidence to much the same effect. The court was not persuaded.

It said the employer had failed to prove that the dismissal was lawful, and found that the contract had been ended by the company alone, without lawful cause and without the required notice period.
