Wife wins divorce after three-year wedding delay

A woman has been granted a divorce after three years of delay and silence from her husband, who failed to hold a wedding or prepare a shared home despite a valid marriage contract.
The Sharia High Court of Appeal ruled in her favour, ending the legal tie with a single revocable divorce before consummation.
The marriage contract had been signed with the promise of a life together, but the man avoided all steps to bring that life into being.
New life
According to her lawyer, Amani Al Ghadawi, the woman was ready to move in and start her life with him, but he kept putting her off.
He did not provide a home, nor did he hold a wedding or make the union public.
Her claim was rejected by the lower court, but the appellate judges came to a different conclusion.
They accepted that the three-year delay, the failure to host the ceremony, and the refusal to prepare a marital home amounted to harm.
In the words of the court, the woman had become “suspended”, neither wife nor divorcee.
