A BD10,000 compensation claim filed by an Asian national injured in a traffic accident has been dismissed after a Bahraini appeals court upheld the validity of a notarized waiver signed by the claimant.
The claimant sought final compensation for injuries and damages following an accident in which the first defendant was convicted of causing injury through negligence, among other offences.
Although the High Civil Court initially ordered the defendants to pay BD10,000, the Third Civil Division of the High Court of Appeals overturned the ruling and dismissed the claim.
The appeals court found that the claimant had previously signed a notarized document relinquishing his criminal, civil and personal rights in the case and had received amicable compensation.
The court ruled that the waiver was clear and binding and could not be revoked years later to pursue another compensation claim.
