Unlicensed medicines ordered confiscated for health authority

The Court of Cassation has ordered unregistered and unlicensed medicines seized from a shop to be confiscated for the benefit of the National Health Regulatory Authority. The case involved a shop owner accused of selling pharmaceutical products without a licence and possessing medicines that were not registered with the authority. The Minor Criminal Court initially acquitted him, but the High Criminal Court later ordered the confiscation of the seized medicines while upholding the rest of the ruling. The Attorney General challenged the decision before the Court of Cassation. The top court ruled that unregistered and unlicensed medicines can be confiscated when they were possessed for sale or trade, even if the defendant is acquitted of the offence. It partially amended the ruling after finding that the lower court had failed to specify which authority should receive the confiscated items.
