Ministry’s lawsuit against man denied

ManamaThe High Civil Court rejected the lawsuit filed by the Ministry of Housing (MoH) to evict a Bahraini man from an apartment provided by the ministry.  

The ministry took the man to court after the ministry inspectors found that he didn’t occupy it, instead his sister was using it. 

The local rule for housing stipulates government-built houses and apartments to be used by it’s beneficiaries, otherwise the ministry has the right to cancel the contract. 

In this case, the High Civil Court stated that the ministry hadn’t provided sufficient evidences that confirm that the man had violated the contract terms. 

According to the court, though the inspectors found that the man’s sister was living in the apartment, it didn’t mean that he wasn’t using it. The man earlier suggested that due to his working hours he couldn’t be found in the apartment. 

His neighbours told detectives that they knew that the apartment was occupied, but they didn’t know who was the tenant. Defence witnesses have also confirmed that the man lived in the apartment with his family.
